These Terms of Use (“Terms”) constitute a legally binding agreement between Klosurequest Technologies Private Limited (referred to as “We,” “Us,” “Our,” or “Kustodian.life”) encompassing our website https://kustodian.life/ (“Website”) and all associated web pages and mobile applications linked to it that are owned by us, (“Services”), and You, a user accessing our Services or visitor of our Services (referred to as “User”, “you” or “your”). For corporate entities or organizations, references to “you” and “your” shall extend to your employees, representatives, and agents.
By using any of the Services, you are agreeing to these Terms. If you do not agree to these Terms, then you are not allowed to use the Services and should immediately cease such usage. Furthermore, by accepting these Terms, you acknowledge that our Privacy Policy is an integral part of your agreement to these Terms. These Terms are in addition to the terms outlined in a separate definitive user agreement (“User Agreement”) entered into between you and Kustodian.life and shall serve as a binding annexure to such User Agreement.
1. GENERAL TERMS

a. We reserve the right to refuse Services to any individual at our discretion and without prior notice.

b. You agree not to replicate, imitate, duplicate, sell, exploit, or misuse any aspect of the Service, or any interaction facilitated through the Services, without our explicit written permission.

c. The titles used in these Terms are for reference convenience only and do not limit or otherwise affect these Terms.

d. Kustodian.life does not engage in agreements with minors (individuals below the age of 13 years). By using our Services, you confirm that you are not a minor. If you are a minor, you must have the consent and supervision of a parent or legal guardian to use the Services. Kustodian.life reserves the right to verify Users’ ages and may suspend or terminate accounts found to be in violation of this policy. The parent or legal guardian shall be liable for the minor’s use of the Services, including any financial transactions or obligations incurred through such use.
2. SCOPE OF SERVICE

a. Kustodian.life, is dedicated to aiding Users in facilitating the seamless transfer of their assets to their family and loved ones upon their passing. Additionally, we offer assistance in resolving KYC and other issues pertaining to various financial assets including but not limited to PF, Bank Accounts, Physical Assets including Property and Vehicles, Insurances, will planning, and extend support to High Net Worth Individuals (HNIs) in estate planning.

b. The scope of services rendered by Kustodian.life shall be contingent upon and aligned with the services explicitly requested and outlined by you in the User Agreement. The User Agreement, to be entered between you and Kustodian.life, will define the specific services, terms, conditions, and responsibilities governing our engagement with you.
3. USE OF SERVICE

a. Authorized Use: By accessing our Services, you agree to use them solely for their intended purposes in accordance with these Terms and any applicable laws and regulations.

b. User Account: To access certain features of the Services, you may need to create a User account. By doing so, you consent to the use of the information such as your and/or your nominee’s name, phone number, email ID, and any other details deemed necessary by Kustodian.life for the provision of requested Services. You are responsible for obtaining any consent required for furnishing such information, the accuracy of the information furnished and maintaining the confidentiality of your account credentials as well as for all activities that occur under your account.

c. Acceptable Use:

i. Lawful Use: You commit to using Kustodian.life’s Services in compliance with all applicable laws and regulations, refraining from any activities that contravene local, national, or international laws.

ii. Respect for Third-Party Rights: You will honour the intellectual property rights, privacy, and legal entitlements of Kustodian.life, its users, and third parties. Avoid unauthorized utilization or reproduction of copyrighted materials or infringement upon intellectual property rights.

d. No Harmful Activities: Use of Kustodian.life’s Services shall not involve any detrimental activities, including, but not limited to:

i. Uploading, transmitting, or disseminating malicious code, viruses, or harmful software.

ii. Disrupting the proper functioning of the Services.

iii. Attempting unauthorized access to Kustodian.life’s systems or networks.

e. Non-Exploitative Use:

Kustodian.life’s Services are meant for their designated purposes and should not be exploited for malicious or unethical activities. This encompasses activities like spamming, phishing, or any form of social engineering.

f. Prohibited Content:

You agree not to upload, post, or transmit any content that is:

i. Defamatory, abusive, or harassing.

ii. Discriminatory based on race, gender, religion, or any other protected characteristic.

iii. Invasive of privacy or infringing upon the rights of others.

iv. False, misleading, or fraudulent.

g. No Unauthorized Access:

Avoid attempting access to parts of the Services not intended for your use. Unauthorized entry, probing, or scanning of Kustodian.life’s systems is strictly forbidden.

h. Compliance with Policies:

You acknowledge and agree to adhere to all policies, guidelines, and instructions provided by Kustodian.life concerning the use of its Services, which may be introduced or updated periodically.
